Key Fact: Delaware
Delaware requires a 10-day pre-filing notice before a mechanics lien can be recorded. No project-start preliminary notice is needed.
Understanding Delaware Requirements
Delaware does not require a preliminary notice at the start of a project. Instead, under Del. Code tit. 25 § 2710, claimants must send a Notice of Intent to File Lien 10 days before filing lien to preserve their right to record a mechanics lien.
While Delaware does not mandate a project-start notice, the pre-filing notice requirement is still a critical step. Failing to send the Notice of Intent to File Lien within the required timeframe will prevent you from recording a valid mechanics lien.
LienFlash is expanding to cover Delaware's pre-filing notice requirements. Our platform will automate the notice generation and delivery process, ensuring you never miss the 10 days before filing lien window.
